If you are under the age of 13, your parent or legal guardian must provide written consent to i-wireless before you provide personal information to i-wireless.

These terms and conditions ("Terms and Conditions"), including our Privacy Policy, which is expressly incorporated herein, govern your use of the prepaid wireless radio telecommunications services and related services and / or features ("i-wireless service" or "Service") with your assigned telephone, data and/or messaging number(s). The term "Phone" means the wireless receiving and transmitting equipment that we have authorized to be used for i-wireless service and programmed with the number and any accessories. The term "airtime card" or "i-wireless card" means a prepaid cellular service card. The Service is provided at our discretion. We can modify or cancel Service, or take corrective action at any time without prior notice and for any reason, including, but not limited to, your violation of any of these Terms and Conditions. We may change or update these Terms and Conditions, including pricing, from time to time. The Terms and Conditions will be updated on the i-wireless website, wire.atl.cdit.us, and you agree that your continued use of the Service will be governed by any updates and by the Terms and Conditions as modified by those updates. While we will generally send you a text message notifying you of material updates to the Terms and Conditions, you should check the i-wireless website for the most recent pricing and Terms and Conditions. These Terms and Conditions supersede all oral or written communications and understandings between you and i-wireless with respect to our products and Services and the terms under which they are offered and provided to you.

IF YOU BUY THE PHONE OR USE THE SERVICE, YOU ARE DEEMED TO CONSENT TO THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS OR DO NOT AGREE TO ANY UPDATED TERMS AND CONDITIONS, DO NOT USE THE PHONE OR SERVICE FOLLOWING THE UPDATE AND NOTIFY US IMMEDIATELY TO CANCEL SERVICE. IF YOU CANCEL SERVICE PRIOR TO YOUR FIRST USE OF THE SERVICE, YOU MAY RETURN THE PHONE TO THE PLACE OF PURCHASE WITHIN FOURTEEN DAYS FOR A FULL REFUND OF THE PURCHASE PRICE OF THE PHONE AND ANY SERVICE PURCHASED PRIOR TO USE. IF YOU NOTIFY US THAT YOU DO NOT AGREE TO AN UPDATE, YOU WILL NOT BE PERMITTED TO ADD FUNDS, ADDITIONAL UNITS OR AIRTIME TO YOUR ACCOUNT AND YOUR SERVICE WILL BE CANCELLED EFFECTIVE UPON YOUR ACCOUNT BALANCE REACHING ZERO. CANCELLATION OF YOUR SERVICE, AND ANY APPLICABLE REFUND SPECIFIED IN THIS PARAGRAPH IS YOUR ONLY REMEDY IN THE EVENT YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS OR ANY UPDATE TO THEM.

General Terms & Conditions

Coverage Map:

The Home Service Area is generally depicted on the coverage maps at wire.atl.cdit.us. Coverage maps only approximate our service coverage. You are responsible for verifying coverage in your area. Actual service may be affected by numerous factors not depicted on coverage maps.

Expired Service Plans:

i-wireless has service plans that are no longer available for purchase. If you are an existing customer using one of these service plans, you may continue to use your current plan or switch to one of our new plans. If you continue to use such plan, it will be available to you until your account expires, unless the plan is earlier terminated at our discretion.
We reserve the right to discontinue availability for these expired plans at any time. If your account expires or you choose a new plan you will not be able to switch back to these expired plans.

Account Balance Restrictions

Customers may not carry forward an account balance greater than $400.00. Customers must top up by the expiration date according to the card last used in order to avoid account deactivation. In the case that a customer adds funds to their account that causes the balance to exceed the maximum allowed ($400.00), the addition will be allowed, dollars will be accepted and the expiration date will be extended, however, the account balance will remain at $400.00.

Cancellation:

You are free to cancel Service at any time. After your first use, however, you will receive no refunds on any equipment, including Phones or any unused funds in your account. Monthly Service Fees are non-refundable. You may cancel your account or change your rate plan by visiting wire.atl.cdit.us or by dialing 611 from your Phone. Your phone number will be reclaimed 180 days from the last date that funds were added to your account.

CPNI Consent:

Under federal law, you have a right, and i-wireless has a duty, to protect the confidentiality of information regarding the amount, type and destination of your wireless service usage ("CPNI"). You consent to i-wireless sharing your CPNI internally, and with its affiliates and its contractors to develop or bring to your attention any products or services, and to i-wireless transferring your CPNI in the event of any merger, sale of some or all of the company assets or acquisition, as well as in the event of any insolvency, bankruptcy or receivership proceeding in which CPNI or other personal information would be transferred as one of the business assets of the company. This consent survives the termination these Terms and Conditions and your use of the Service, and is valid until you revoke it. To revoke your CPNI consent at any time, notify us in writing at i-wireless Attention: CPNI Officer, 1 Levee Way, Suite 3104, Newport, Kentucky 41071 and provide your (1) name, (2) home address, (3) home telephone number (including area code), (4) Number for your Phone (including area code), 5) Service billing address, and (6) Service account number. Revoking your CPNI consent will not affect your current wireless service. Please see our Privacy Policy for details.

Account Information:

Unless notified otherwise, we will assume the individual in possession of the Phone is the account holder. Any person able to provide the appropriate account password, together with the wireless number is authorized by you to receive information about and make changes to your account, including adding new Service. We collect information about the approximate location of your Phone and use that information, as well as other usage and performance information also obtained from our network and your Phone, to provide you with Service, and to maintain and improve our network and the quality of your service experience. We may also use location information to create aggregate data from which your personally identifiable information has been removed or obscured. Such aggregate data may be used for a variety of purposes such as scientific and marketing research and providing ancillary services. It is your responsibility to notify users on your account that we may collect and use location information from a Phone.

You consent to disclosure of any information about you to any person as permitted by law if the device programmed with your number calls an Emergency service number such as 911 or, if we reasonably believe that an emergency involving immediate danger of death or serious physical injury to any person requires disclosure of communications or justifies disclosure of records without delay. This consent survives the termination of these Terms and Conditions and your use of the Service.

You have no ownership rights to your phone number or other identifier provisioned by i-wireless, our agents or the manufacturer of the Phone and you agree that we reserve the right to change your phone number or other identifier at any time without prior notice to you.

Content:

The Services available through your i-wireless Phone may allow you to access the Internet, text, pictures, games, graphics, music, email, sound and other materials ("Mobile Content") and send Mobile Content elsewhere. These Services may be dependent upon the make and model of your Phone. While we attempt to prevent inappropriate material, some Mobile Content is available from us or our business partners, while other Mobile Content can be accessed from other third-party websites or services. We make absolutely no representations, warranties or guarantees about the Mobile Content you access on your i-wireless Phone. Mobile Content may be accessible which is: (1) unsuitable for children/minors; (2) unreliable or inaccurate; or (3) offensive, indecent or objectionable. You are solely responsible for evaluating the Mobile Content accessed by you or anyone using your i-wireless Phone. We strongly recommend that you monitor content access by children or minors. Prior to accessing certain Mobile Content, which may be inappropriate for children or minors, we (or the site providing the Mobile Content) may require you to provide certain personal information in order to verify that you are at least 18 years of age. Mobile Content from third parties may also harm your i-wireless Phone or its software. To protect our network or Services, or for any other reason, we may place restrictions on accessing certain Mobile Content, impose separate charges, limit the amount of data you can access or transfer, or otherwise limit or terminate Services.

Messaging:

Dependent upon your handset capabilities, you can generally send and receive text messages of up to 160 characters, or picture messages with audio and up to 500 characters on your Phone.

Preventing Unwanted Text Messages:

If you are receiving unwanted text messages, contact the source and unsubscribe or remove your phone number from the texting service. Even if you elect not to receive text messages, you may still receive service and other alerts from i-wireless or its authorized agents. You hereby consent to receiving advertising, other service alerts or other broadcast messages from i-wireless or its authorized agents. You will not be charged for alerts. If you elect to prevent the receipt of text messages, and you subsequently sign up for an alert from any other source, you must first change your text messaging settings to permit the receipt of alerts and all text messages.

Sending Unsolicited Messages:

If you intentionally send unsolicited messages from your i-wireless Phone or if your Phone is being used as a conduit to send unsolicited messages, we may terminate your Service without further notice.

Acceptable Use of i-wireless Products and Services:

I-wireless reserves the right to terminate your Service for violating any of the acceptable uses of the product or service.

Private/Non-Commercial Use:

i-wireless and its business partners provide messages, data, information, music, games, images, text, and other material for your private, non-commercial use only. You may not sell or resell this content. You may not upload and transmit or broadcast this content in public places. These uses are expressly prohibited by i-wireless. You will be solely responsible if you engage in any unauthorized use of this content. Voice services are provided for live dialogue between two individuals and may not be used for monitoring services, data transmissions or other connections that do not consist of uninterrupted live dialogue between two individuals. i-wireless phones and phone numbers may not be used for pager or voicemail retrieval service. In addition, you may not Post any content that solicits any information from other customers or involves any commercial activities, including advertisements.

Content Objectionable or Offensive to Third Parties:

You may not publish, copy, reproduce, upload, download, post, distribute, edit, modify, or otherwise transmit ("Post") any content that is unlawful, in contravention of a court order, libelous, defamatory, slanderous, obscene, pornographic, harassing, threatening, abusive, harmful, or otherwise objectionable, or that infringes upon or otherwise violates others' rights, including privacy rights.

Unlawful Content:

You may not Post any content that encourages or is in furtherance of an unlawful, criminal, or fraudulent activity or that violates any of these Terms and Conditions or other i-wireless rule or policy.

Infringing Content:

You may not Post any content that may infringe on or otherwise violate any patent, trademark, trade secret, copyright, or other intellectual property or proprietary right of any person. Infringement may result from the unauthorized copying, posting, editing, modifying or distributing of any content, including ringtones, graphics, pictures, photographs, logos, software, articles, music, games, or videos. By Posting any content, you represent that you have legal rights to use, distribute, and publish such content.

Harmful Content:

You agree not to Post any content that contains viruses, worms, time bombs, or other similar programs that would interfere with or disrupt our provision of Services.

Removal of Objectionable Content:

We reserve the right, in our sole discretion, to remove or delete any content that you Post on our Service that violates these Terms and Conditions or is otherwise deemed objectionable by us in our sole discretion. We may delete content that you have downloaded to your personal vault or limit the amount of content that you may download during any given period.

Unauthorized Usage:

Services are provided by i-wireless using the nationwide Sprint PCS network exclusively with i-wireless Phones purchased from i-wireless or an authorized retailer. You cannot use our Service with any other phone or device or on any other network. Airtime may be used for domestic and international calling from the United States and for related services as contemplated by these Terms and Conditions. i-wireless Phones and phone numbers may not be used for pager or voicemail-only service, and i-wireless may terminate any account if usage is limited to pager service or voicemail retrieval service. As a way to minimize unauthorized usage, i-wireless reserves the right to automatically terminate all calls exceeding 120 minutes in length. You may reestablish the call at anytime.

You agree not to use the Phone or Service for any unlawful, unauthorized or abusive purpose or in any way that damages our property or others' property or interferes with, harms or disrupts our systems or other operators' systems. You may not alter any of the hardware or software on your Phone. The Service is for personal use and our Phones, Services and Products may not be purchased in bulk or sold to third parties. You may not install any amplifiers, enhancers, repeaters or other devices that modify, disrupt or interfere in any way with the radio frequency licensed to us to provide Service. If your Phone, user name or password is stolen or Service is fraudulently used, you must immediately notify us and provide us with such documentation and information as we may request (including affidavits and police reports). Until you notify us, you will remain responsible for all charges. You agree to cooperate with us in any fraud investigation and to use any fraud prevention measures we prescribe. Failure to provide reasonable cooperation may result in your liability for all fraudulent usage.

Suspension or Termination of Service:

We reserve the right to issue a warning and to suspend or terminate your access to our Service at any time should we determine in our sole discretion that you have violated these Terms and Conditions or any other rule or policy of i-wireless, or for any other reason in our sole discretion.

Disclosure of Content:

To comply with appropriate legal process, i-wireless may disclose to law enforcement authorities any information, including your name, account history, account information, or other transmission data requested by law enforcement. We also may disclose to third parties any content necessary to respond to claims that such content violates the rights of third parties or to protect the rights and property of i-wireless.

Calls to Customer Care:

Use of the Service includes a reasonable number of calls to our customer care department for inquiries concerning usage, billing, or technical problems. We reserve the right to determine that the number of calls or the requests made to our customer care department are excessive and a violation of these Terms and Conditions.

Use of Service/Device Number:

Reproduction, transmission, dissemination or resale of Service is prohibited without prior written contractual arrangements with i-wireless, together with any required regulatory approvals. i-wireless has the right to interrupt or restrict Service to your number without prior notice if i-wireless suspects fraudulent or abusive activity or in our efforts to combat fraudulent use. The Phone cannot be activated with any other wireless carrier. Your Phone may contain preinstalled software necessary to use our Service. By using our Service, you agree to abide by the terms and conditions of any applicable software license. You may not reprogram the Phone or program the number into any equipment other than the Phone or change the electronic serial number (ESN) or equipment identifier (EID) of the Phone. This paragraph survives the termination of these Terms and Conditions and your use of the Service.

Availability/Interruption:

Service is normally available to your Phone when it is within the operating range of our system (see the i-wireless Coverage Map) and may be available outside of that area in other participating carrier service areas. Coverage maps only approximate our outdoor service coverage. Service functionality may vary when outside the operating range of our system. Service is subject to transmission limitations, reduction in transmission speed, or interruption caused by weather, your equipment, terrain, obstructions such as trees or buildings, or other conditions. Service may be limited in some areas where coverage is not available or may be temporarily limited or interrupted due to system capacity limitations, system repairs or modifications, or in response to suspected fraud, abuse, misuse of the network, hacking or malicious viruses. Interruption may also result from nonpayment of charges by you or other violation of these Terms and Conditions or i-wireless rule or policy. We may block access to certain categories of numbers (e.g. 976, 900 and certain international destinations) or certain websites if, in our sole discretion, we are experiencing excessive billing, collection, fraud problems or other misuse of our network. We may, but do not have an obligation to, refuse to transmit any information through the Service and may screen and delete information prior to delivery to you or the Phone as permitted by law. Some aspects of the Service may be temporarily unavailable if a child under the age of 13 provides personal information. Without parental consent, children under the age of 13 will not be able to use certain aspects of the Service. Phones may be incompatible with TTY, so TTY users may be unable to make emergency calls. 911 or other emergency service may not be available or reliable and your ability to receive emergency services may be impeded.

Limitations

Both you and we intend that the limitations on liability, warranty and damage awards provided for in these Terms and Conditions will apply to the fullest extent allowed by law. Some jurisdictions do not allow the limitation or exclusion of certain warranties or the waiver, limitation or exclusion of certain damages, or for intentional or willful conduct in some circumstances. To the extent that applicable law does not permit any of these limitations, they will not apply to you. You may not have other rights, which vary from state to state.

Limitation of Liability:

WE ARE NOT LIABLE FOR ACTS OR OMISSIONS OF ANOTHER SERVICE PROVIDER OR ANY THIRD PARTY PROVIDERS OF SERVICES RELATED TO USE OF THE PHONE OR SERVICE, FOR INFORMATION PROVIDED THROUGH YOUR PHONE, LACK OF PRIVACY OR SECURITY EXPERIENCED WHEN USING THE PHONE, EQUIPMENT FAILURE OR MODIFICATION OR CAUSES BEYOND OUR REASONABLE CONTROL, INCLUDING WITHOUT LIMITATION ANY REPRESENTATIONS THAT THE SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE FROM UNAUTHORIZED ACCESS (INCLUDING THIRD PARTY HACKERS OR DENIAL OF SERVICE ATTACKS). WE ARE NOT LIABLE FOR SERVICE OUTAGES OR FOR SERVICE LIMITATIONS OR INTERRUPTIONS. OUR LIABILITY AND THE LIABILITY OF ANY UNDERLYING CARRIER FOR ANY DAMAGES ASSOCIATED WITH ANY CLAIMS AGAINST US OR SUCH UNDERLYING CARRIER SHALL IN NO EVENT EXCEED OUR PRORATED CHARGES RELATING TO THE APPLICABLE PERIOD OR PHONE. WE ARE NOT LIABLE FOR ANY INCIDENTAL, PUNITIVE, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES, LOST PROFITS, LOST REVENUE OR LOSS OF BUSINESS OR USE.

YOU AND WE BOTH WAIVE TO THE FULLEST EXTENT ALLOWED BY LAW, ANY CLAIMS TO RECOVER INCIDENTAL, PUNITIVE, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES, LOST PROFITS, LOST REVENUE OR LOSS OF BUSINESS OR USE. IN ADDITION, WE ARE NOT LIABLE FOR (i) INJURIES TO PERSONS OR PROPERTY ARISING FROM USE OF THE SERVICE, THE PHONE OR ANY EQUIPMENT USED IN CONNECTION WITH THE PHONE OR THE SERVICE, OR (ii) THE INSTALLATION OR REPAIR OF THE PHONE BY ANY PARTIES WHO ARE NOT OUR EMPLOYEES. WE ARE NOT RESPONSIBLE FOR FAILURES TO CONNECT OR COMPLETE 911 OR OTHER EMERGENCY CALLS IF INACCURATE INFORMATION IS PROVIDED. WE ARE NOT LIABLE FOR ANY ACT ASSOCIATED WITH THE PROPER EXERCISE OF RIGHTS UNDER THE PROVISIONS OF THESE TERMS AND CONDITIONS. RELATING TO PRIVACY, CPNI, PERSONAL OR ACCOUNT INFORMATION AND/OR UNAUTHORIZED USAGE. THIS PARAGRAPH SURVIVES THE TERMINATION OF THESE TERMS AND CONDITIONS AND YOUR USE OF SERVICE.

Indemnification:

YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD US, OUR OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES AND AGENTS AND ANY OTHER SERVICE PROVIDER HARMLESS FROM CLAIMS OR DAMAGES RELATING TO THESE TERMS AND CONDITIONS OR YOUR OBLIGATIONS SET FORTH IN THESE TERMS AND CONDITIONS OR USE OF THE PHONE OR SERVICE, UNLESS DUE TO OUR SOLE NEGLIGENCE. AMONG OTHER THINGS, YOU MUST PAY ALL CHARGES OF ANY LONG DISTANCE COMPANY THAT CARRIES YOUR CALLS, EVEN IF WE CONNECT YOUR CALL TO A LONG DISTANCE COMPANY OTHER THAN THE ONE YOU REQUEST. YOU ALSO AGREE TO PAY OUR REASONABLE ATTORNEYS' AND EXPERT WITNESS FEES AND COSTS INCURRED IN ENFORCING THESE TERMS AND CONDITIONS THROUGH ANY APPEAL. THIS PARAGRAPH SURVIVES THE TERMINATION OF THESE TERMS AND CONDITIONS AND YOUR USE OF SERVICE.

No Warranties:

WE MAKE NO EXPRESS WARRANTY REGARDING THE SERVICE OR THE PHONE AND DISCLAIM ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT AUTHORIZE ANYONE TO MAKE ANY WARRANTY ON OUR BEHALF AND YOU SHOULD NOT RELY ON ANY SUCH STATEMENT. WE ARE NOT THE MANUFACTURER OF THE PHONE AND ANY STATEMENT REGARDING IT SHOULD NOT BE INTERPRETED AS A WARRANTY. THIS PARAGRAPH SURVIVES THE TERMINATION OF THESE TERMS AND CONDITIONS AND YOUR USE OF SERVICE.

Resolution of Disputes:

Please read this section carefully. It affects rights that you may otherwise have. It provides for resolution of most disputes through arbitration instead of court trials and class actions. Arbitration is final and binding and subject to only very limited review by a court. This "Resolution of Disputes" section survives the termination of these Terms and Conditions, and your use of the Service.

Binding Arbitration:

This provision is intended to be broadly interpreted in order to encompass all disputes or claims arising out of our relationship. Any dispute or claim, including those against any of our subsidiaries, parent or affiliate companies, arising out of or relating to these Terms and Conditions, (including our Privacy Policy) or the Service or any Phone or other equipment used in connection with the Service (whether based in contract, tort, statute, fraud, misrepresentation or any other legal theory, and whether arising before or after the initiation or termination of these Terms and Conditions or your use of the Service) will be resolved by binding arbitration except that you or we may choose to pursue claims in court if the claims relate solely to the collection of any debts you owe to us.

Arbitration Procedures:

You must agree to contact us first with any disputes. If you dispute any charges to your account, you must notify us within 60 days after the charge appears on your account. You must contact our Customer Care Department to allow us an opportunity to resolve any disputes. If any dispute is not resolved within 60 days either party may request arbitration. The arbitration of any dispute or claim shall be conducted in accordance with the American Arbitration Association ("AAA") under the Wireless Industry Arbitration Rules ("WIA Rules"), as modified by these Terms and Conditions. The WIA Rules and information about arbitration and fees are available upon request from the AAA online at www.adr.org. You and we agree that these Terms and Conditions evidence a transaction in interstate commerce and this arbitration provision will be interpreted and enforced in accordance with the Federal Arbitration Act and federal arbitration law. Unless you and we agree otherwise, any arbitration will take place in the county seat for the county in which your billing address is located. At either party's election, the arbitration shall be held telephonically. An arbitrator may award any relief or damages (including injunctive or declaratory relief) that a court could award, except an arbitrator may not award relief in excess of or contrary to what these Terms and Conditions provide and may not order relief on a consolidated, class wide or representative basis. In any arbitration applying the WIA Rules applicable to large/complex cases, the Arbitrators must also apply the Federal Rules of Evidence, and the losing party may have the award reviewed in accordance with the review procedures set forth in the WIA Rules. Judgment on any arbitration award may be entered in any court having proper jurisdiction. If any portion of this arbitration clause is determined by a court to be inapplicable or invalid, then the remainder shall still be given full force and effect.

Cost of Arbitration:

For claims of less than $1,000, you will be obligated to pay $25 and we will pay all other administrative costs and fees. For claims over $1,000 but under $75,000, you will be obligated to pay your share of the arbitration fees, but no more than the equivalent court filing fee for a court action filed in the jurisdiction where your billing address is located. For arbitrations of claims in excess of $75,000, all administrative fees and expenses of arbitration will be divided equally between you and us. In all arbitrations, each party will bear the expense of its own counsel, experts, witnesses and preparation and presentation of evidence at the arbitration.

Waiver of Class Action; Jury:

By these Terms and Conditions, both you and we are waiving certain rights to litigate disputes in court. You and we both agree that any arbitration will be conducted on an individual basis and not on a consolidated, class wide or representative basis. If for any reason this arbitration clause is deemed inapplicable or invalid, or to the extent this arbitration clause allows for litigation of disputes in court, you and we both waive, to the fullest extent allowed by law, any right to pursue any claims on a class or consolidated basis or in a representative capacity and any right to a jury trial.

Limitations Period

Subject to the provisions of these Terms and Conditions regarding disputing charges to your account and any arbitration or legal action with respect to any and all claims or causes of action related to or arising out of these Terms and Conditions must be brought within two years after the cause of action arises, or within the applicable statutory period of time, whichever is shorter. This limitations period does not apply to any given cause of action when the statutory limitations period for that cause of action cannot be waived, restricted or otherwise limited by you.

Privacy

You understand that there is no such thing as "perfect security" for electronic or radio communications. You understand and agree that no steps we take will guarantee that your use of the Services is invulnerable to all security breaches. We make no warranty, guarantee, or representation that use of any of our Services is protected from viruses, security threats or other vulnerabilities. We are not liable for any lack of privacy that may be experienced with regard to the Service. You authorize our monitoring and recording of calls to us concerning your account or the Service and consent to our use of automatic dialing equipment to contact you. We have the right to intercept and disclose any transmissions over our facilities in order to protect our rights or property. Our Privacy Policy is expressly incorporated into these Terms and Conditions. A full copy of our Privacy Policy is available at wire.atl.cdit.us.

Assignment:

We may assign all or part of these Terms and Conditions without such assignment being considered a change to the Terms and Conditions, and without your consent or notice to you. Upon such assignment, we are then released from all liability. You may not assign these Terms and Conditions without our prior written consent.

Third Party Beneficiaries:

No provision of these Terms and Conditions provides any person or entity not a customer subject to these Terms and Conditions with any remedy, claim, liability, reimbursement, or cause of action, or creates any other third party beneficiary rights.

Notices:

Written notices to you shall be effective 3 days following the date deposited in the U.S. Mail addressed to your address as kept in our records. You are responsible for notifying us of any changes in your address. Text messages sent by i-wireless shall be in effect when the message is sent. Written notice to us shall be effective when directed to our Customer Care Department and received at our address at 1 Levee Way, Suite 3104, Newport, KY, 41071. Your notice must specify your account number and mobile phone number. Oral notices made by i-wireless shall be deemed effective on the date reflected in our records. We will not give you notice of any subpoenas or court orders related to your account or use of Service unless required by law.

Governing Laws:

These Terms and Conditions are subject to applicable federal laws, federal or state tariffs, if any, and will be governed by and construed in accordance with the laws of the state of North Carolina without regard to choice of law provisions. Where our Service Terms and Conditions are regulated by a state agency or the FCC, the regulations are available for your inspection; if there is any inconsistency between these Terms and Conditions and those regulations; these Terms and Conditions shall be deemed amended as necessary to conform to such regulations. i-wireless conducts business in the state of Illinois under the name K-Wireless.

No Waiver:

No term or provision hereof shall be deemed waived and no breach excused unless such waiver or consent is in writing and signed by the party claimed to have waived or consented. Any consent by either party to, or waiver of, a breach by the other, whether express or implied, shall not constitute consent to, waiver of, or excuse for any other different or subsequent breach.

Partial Invalidity:

If any term or provision of these Terms and Conditions operates or would prospectively operate to invalidate these Terms and Conditions in whole or in part, then such term or provision only will be void to the extent of such invalidity, and the remainder of these Terms and Conditions shall remain in full force and effect; provided, however, that if such term or provision constitutes the essence of these Terms and Conditions, then these Terms and Conditions shall be deemed terminated without such termination constituting a breach herein.

Lost of Stolen Equipment or i-wireless Cards:

i-wireless is not responsible for lost or stolen equipment, including but not limited to Phones or i-wireless cards. Call i-wireless Customer Care at 1-866-594-3644 immediately to suspend your Service. You are responsible for charges incurred until you notify us of the loss of your Phone.

Trademarks and Licenses:

The i-wireless brand and family of marks are registered trademarks used under license by i-wireless. Sprint and Sprint PCS are registered trademarks of Sprint. You agree not to infringe, misappropriate or otherwise violate the intellectual property rights of i-wireless, Sprint or any other carrier. You agree that a violation of this paragraph causes harm that cannot be fully redressed by monetary damages, and that in the event of such violation or threatened violation, i-wireless is entitled to immediate injunctive relief, without posting a bond or additional security, in addition to all other rights and remedies available.

Export:

You agree to comply with all trade regulations and export control laws, both domestic and foreign. i-wireless Phones, equipment, software, and any underlying information accessed or transferred by you using i-wireless Services may be subject to U.S. export controls, including the Export Administration Act (50 U.S.C. 2401, et seq.) and the Export Administration Regulations (50 C.F.R. 730-774), as well as the import regulations of other countries. You agree not to export or re-export any i-wireless phones, equipment, or software to any foreign country. Any information transferred by you using i-wireless' Services to any foreign country, entity, or person must comply with the U.S. Export Administration Act and the Export Administration Regulations.

Safety:

Always use your Phone in a safe manner that does not create a risk to your safety or the safety of others around you. While driving, always use a hands-free device and never use your Phone to send messages or browse the Internet. Always use your mobile phone and device in accordance with all applicable laws and regulations.

Miscellaneous:

Fees, Activation & Miscellaneous Charges
i-wireless charges a $39 account Activation Fee which is billed to your Account. We may also charge prepayment, reactivation, program, or other fees to establish, change, or maintain Services. Certain transactions may also be subject to a charge (for example, convenience payment, changing phone numbers, handset upgrades, etc.). You will be provided notice of these types of fees before we complete the requested transaction.

One Time Device Purchase Credit
If you purchased your i-wireless or Access Wireless handset or participated in the Bring Your Own Sprint Device (BYOSD) program, you may be eligible for a one-time device purchase credit. The one-time credit is at the discretion of i-wireless and will be applied to your i-wireless or Access Wireless account at the time of activation.

This "Miscellaneous" section survives the termination of these Terms and Conditions and your use of the Service.

Device Warranty Terms & Conditions

All i-wireless handsets come with a limited warranty. If you encounter a problem with your device, subscribers should call 1-866-594-3651 to see if their handset qualifies for the limited warranty. Please note that handset warranties are not transferable from one customer to another. i-wireless does not support warranties for any devices that were not purchased through i-wireless or an authorized i-wireless retail location.

New Device Warranty

Every new i-wireless device purchased comes with a limited 1-year manufacture's warranty. If your device experiences a manufacturing defect within 1-year of the purchase date, please contact Customer Care at 1-866-594-3644 for detailed instructions on how to properly process your warranty, if applicable. NOTE: Manufacturing defects are malfunctions that occur to the device from no fault of the owner. Damage that is NOT considered defective includes, but is not limited to: Cracks on or damage to the handset case indicating that the handset has been dropped; Damage indicating that the handset has been exposed to liquid; LCD damage such that the handset screen has cracks or blue spots; Handsets that have been modified or tampered with, aka “Jailbreaking.”

Reconditioned Device Warranty

All Reconditioned i-wireless devices come with a limited 60-day manufacture's warranty. If your device experiences a manufacturing defect within 60-days of the purchase date, we will fix or replace that device with another reconditioned handset of the same model or similar device, chosen at i-wireless' discretion, if the original model is not available. Manufacture defects are malfunctions that occur to the device from no fault of the owner. Damage that is NOT considered defective includes, but is not limited to: Cracks on or damage to the handset case indicating that the handset has been dropped; Damage indicating that the handset has been exposed to liquid; LCD damage such that the handset screen has cracks or blue spots; Handsets that have been modified or tampered with, aka “Jailbreaking.”

Lost or Stolen Device

A lost or stolen device is NOT covered under i-wireless’ Limited Warranty. If a device is lost or stolen, customers should call 1-866-594-3644 immediately to suspend your service. Ask Customer Care about handset replacement options that may be immediately available to you. You will be charged for any calls made prior to when you reported your handset as stolen.

ALL-IN PLANS Terms & Conditions

All-In rate plans provide the user with a specified allotment of combined voice minutes, text messages and data for a flat fee and is valid for use within a 30-day period or until the user adds funds to their account balance, dependent on which event first transpires. Each plan option is directly associated with a specific flat fee. When additional funds are added to the account balance, any remaining unused voice minutes, text messages or data will be automatically removed from the account prior to the new specified allotment being added to the account.

Voice Minutes:
Partial minutes of use are rounded up to the next full minute. Time starts when you press “Talk” or your Device connects to the network and stops when you press “End” or the network connection otherwise breaks. You’re charged for all calls that connect, even to answering machines, voicemail, or voice transcription services. You will not be charged for unanswered calls or if you get a busy signal. For incoming calls answered, you’re charged from the time shortly before the Device starts ringing until you press “End” or the network connection otherwise breaks. You’re charged for the entire call based on the rate that applies to the time period in which the call starts. However, the types of charges actually deducted from your account balance will vary depending on your Service. Call time data displayed on your device may be inaccurate and may not be relied upon for determining charges to your account. Calls are limited to two hours. The call will automatically terminate after two hours.

Text Messages:
Text messages originating from your device are deducted from your plan’s specified allotment, should a restricted number be allowed. Text messages received on your device are not counted against that allotment. For picture messaging and other multi-media messaging, deductions from your specified text and data allotments will occur simultaneously based upon the type and size of the message being sent or received and in accordance with the plan under which you are receiving service. Text messages are limited to 160 characters in length. In the event that a message exceeds this character limit, additional messages will be deducted from your specified allotment as dictated by the character count.

Data Usage:
Depending on your Service, you may be charged for data usage. Unless we specifically tell you otherwise, data usage is measured in bytes, kilobytes, megabytes, and gigabytes—not in minutes/time. 1024 bytes equal 1 kilobyte (“KB”), 1024 KBs equal 1 megabyte (“MB”), and 1024 MBs equal 1 gigabyte (“GB”). Bytes are rounded up to KB, so you will be charged at least 1 KB for each data usage session (“data session”). Rounding occurs at the end of each data session and sometimes during a data session. Data usage is charged against the specified allowance included with your plan, and as such you may be subject to limitations on the amount of data usage. You are charged for all data directed to your Device’s Internet address, including data sessions you did not initiate and for incomplete transfers. As long as your Device is connected to our data networks, you may incur data charges. Examples of data for which you will be charged includes the size of a requested file or Data Content (game, ringer, etc.); Web page graphics (logos, pictures, banners, advertisement, etc.); additional data used in accessing, transporting, and routing the file on our network; data from partial or interrupted downloads; re-sent data; and data associated with unsuccessful attempts to reach websites or use applications. These data charges are in addition to any charges for the Data Content itself (game, ringer, etc.). Data used and charged to you will vary widely, even between identical actions or data sessions. Estimates of data usage—for example, the size of downloadable files—are not reliable predictors of actual usage. Please also note that many applications necessitate an always-on capability, meaning a minimal amount of data usage is required to ensure active, real-time transfer of information. This is the case with email sync wherein messages are received via the mail delivery agent (MDA) used with smartphone technology and in other apps that regularly poll for updates or device location. Any plans including unlimited data will provide a specific allotment of high-speed data (up to 4G LTE depending on coverage). Once the high-speed allotment has been used, hot-spot functionality may not be available and data speeds will be reduced for the remainder of the 30-day plan period or until the user adds funds to their account and renews or selects a new plan.

Talk, Text & Data Allotments:
Each plan allotment is valid for 30 calendar days, and includes the associated voice, text and data units detailed below. Each is also inclusive of related telecom taxes, fees and/or surcharges. Sales tax and any federal, state or local charges assessed to telecom products at the point of sale are not included. When a new plan is added, any remaining balance from a previous plan is removed.

All-In Plan Options:

  • $ 10.00 for 100 Talk / Text Units and 50 MB of data. 25 free Picture Messages are also included. Additional picture messages are 20¢ each to send and receive and will be paid for using any unused rewards balance, if available. See terms and conditions for the wireless rewards program for additional details.
  • $25.00 for 200 Talk Minutes, Unlimited* Text Messaging and Unlimited* Data with the first 200 MB provided at speeds up to 4G LTE. Unlimited picture messages are also included.
  • $35.00 for Unlimited* Talk Minutes, Unlimited* Text Messaging and Unlimited* Data with the first 500 MB provided at speeds up to 4G LTE. Unlimited picture messages are also included.
  • $50.00 for Unlimited* Talk Minutes, Unlimited* Text Messaging and Unlimited* Data with the first 2 GB provided at speeds up to 4G LTE. Unlimited picture messages are also included.
  • $75.00 for Unlimited* Talk Minutes, Unlimited* Text Messaging and Unlimited* Data with the first 3 GB provided at speeds up to 4G LTE. Unlimited picture messages are also included.

We reserve the right to change the Fees set forth above or discontinue a rate plan at any time.

*Unlimited does not mean unreasonable.

Adding Talk, Text & Data:

You can add talk, text and data to your All-In plan by using one of our Top-Up methods. You can Top-Up your account by (1) registering a valid credit or debit card to your account. The minimum Top-Up amount when using a credit card or debit card is $10; (2) purchasing i-wireless airtime cards at any of the Kroger family of stores. i-wireless airtime cards are available in $10, $25, $35 and $50 denominations, and can only be used to add the talk, text and data allotments as described above. Each airtime card corresponds directly to its same plan. See terms and conditions on taxes and surcharges for details. (3) Applying your FREE WIRELESS REWARDS toward the purchase of the $10, $25, $50 or $75 All-In plan option. You can use your FREE WIRELESS REWARDS by applying $10, $25, $50 or $75 in FREE WIRELESS REWARDS to the allotment you wish to purchase. You will be prompted on your phone for which method you would like to pursue as you near the end of your service month.

Auto Refill:

You can register to automatically refill your account. By registering for Auto Refill, you agree to have the Auto Refill amount you have selected deducted from your credit card or debit card and added to your i-wireless account once every 30 days. You can establish, modify, or cancel your Auto Refill preferences at any time by logging into your account at wire.atl.cdit.us or by calling i-wireless at 1.866.594.3644. Please note that any airtime loaded between auto refill dates will not negate or reset the auto refill timing.

Payment for Services with FREE WIRELESS REWARDS Balance:

Your FREE WIRELESS REWARDS balance may be used like cash for services such as international calls, Directory Assistance calls and Downloads.

Carry Forward:

Subscribers electing an All-In Plan are not eligible for carry forward minutes. Once a new talk, text and data allotment is added, any remaining unused voice minutes, text messages or data allowance from the prior plan purchased will automatically be removed from the account prior to the new allotment being applied and made available for use.

Unlimited Service:

Unlimited does not mean unreasonable use. To ensure that all i-wireless customers have access to reliable services provided at a reasonable cost, you may not use our Service in a manner that interferes with another i-wireless customer's use of our Service or disproportionately impacts i-wireless' network resources. i-wireless service is intended for personal use only. We have determined that placing a high number of calls, sending or receiving unusually high numbers of messages or data usage or repeatedly placing calls of unusually long duration relative to typical usage by other customers on similar service plans suggests that a mobile phone or device is being used other than for personal use, and is in violation of these Terms and Conditions. If we determine at our sole discretion that you are using an unlimited or other service in violation of these Terms and Conditions or other i-wireless rule or policy, or in any other manner that we deem to be unreasonable or excessive, then we may terminate individual calls or data connections or terminate your Service, decline to renew your Service or offer you a different service plan with no unlimited usage component at any time. We will provide notice via text message that we intend to take any of the above actions.

Unlimited Voice Minutes:

This option allows unlimited voice calls during the 30 day period which Service is offered.

Switching Among Plans:

i-wireless subscribers may switch between any available rate plan at any time. When switching between rate plans you will not receive a refund of any portion of any previously paid charges. For that reason, we recommend that you switch at the end of your 30-day billing cycle if you are on a Monthly Service Plan or after you have used your talk, text or data allotment. When switching between different Monthly Service Plans, ALL-IN subscribers will not be permitted to transfer unused balances into or out of the ALL-IN plans. Excessive switching is not permitted and may result in termination of Service.

FREE WIRELESS REWARDS:

The FREE WIRELESS REWARDS program is administered by i-wireless. If you are a registered participant in the FREE WIRELESS REWARDS program, you will earn a wireless reward for every $100 spent on qualifying purchases at select Kroger-owned store locations when using a registered Kroger family Shopper's card, Rewards card or 1-2-3 Rewards Visa®.

For every $100 spent on qualifying purchases in store, you will automatically receive a $1.00 credit applied to your account balance. If you have registered and authorized recurring billing to your 1-2-3 Rewards Visa®, you will receive a $1.50 credit. You must spend $100 or more to receive the reward. The total amounts you spend will not be rounded up (i.e. 99¢ will not be rounded up to $1.00). Rewards may only be redeemed once (1) per household, per $100 in qualified spending. Qualified purchases do not include payments for taxes, office services, alcohol, tobacco, fuel, tickets, Western Union, Green Dot cards, MoneyPak, Kroger Gift Cards and any purchases prohibited by law. i-wireless and Kroger reserve the right to exclude other purchases. No coupon or certificate is needed to earn rewards minutes.

A maximum of two Kroger family Shopper's cards, Rewards cards or 1-2-3 Rewards Visa® cards may be registered against any one i-wireless MDN. No more than a $1.50 credit can be earned for every $100 in qualified spending, except in the event of select promotional periods, at which time, bonus FREE WIRELESS REWARDS may be awarded. FREE WIRELESS REWARDS are usually applied within 48 hours after the $100 threshold for qualifying purchases is met.

FREE WIRELESS REWARDS may only be redeemed for Kroger i-wireless service in connection with a qualifying i-wireless rate plan, require the use of an i-wireless phone, and are subject to these Terms and Conditions. FREE WIRELESS REWARDS may not be earned if your account is past its Balance Expiration Date. Kroger and i-wireless reserve the right to alter, limit or modify the FREE WIRELESS REWARDS program rules, regulations, rewards, reward level, registration process, or to terminate the FREE WIRELESS REWARDS program at their sole discretion, without notice. By participating in the FREE WIRELESS REWARDS program, you and your household agree to allow i-wireless to use information collected for the marketing purposes of i-wireless, Kroger and their respective affiliates. Customers must have a balance in order to use the following services:

Mobile Web Packs, available on other i-wireless service plans, are not available on the ALL-IN Plan.

Additional content downloads will automatically be deducted from the user’s available rewards balance. Rates vary and are subject to change.

Domestic and International Long Distance allow you to call anywhere in the U.S. and anywhere in the world. In the event you place an International Long Distance call from your Phone, your account will be debited an amount equal to the cost of such call, and the cost shall be calculated based upon the International Long Distance rates currently in effect multiplied by the number of minutes used. Rates and country codes are available at wire.atl.cdit.us.

Calls to Directory Assistance (411) are one dollar fifty cents ($1.50) each plus local per-minute charges. Rates are subject to change.

International Long Distance calls are additional charges: as such, the airtime minutes used are included and the minutes used will not be debited against your minute balance.

Standard airtime charges apply to 800, 866, 877 and other toll-free calls.

Incoming advertising alerts or other broadcast messages from i-wireless or its authorized agents, such incoming calls and messages are not charged against your account balance.

Taxes and Surcharges:

Stated prices for our Services on the ALL-IN Plan, include taxes and/or surcharges. Taxes include state and local taxes, as well as surcharges for federal and state Universal Service Fund contributions and state and local 911 fees. Charges may also include a cost recovery surcharge. The amount of these surcharges may vary from time to time and by area. Sales tax and other fees assigned by federal, state, or local governments at the point of sale are not included in the ALL-IN Plan rates.

Replenishing Your Account

You can replenish (i.e. add funds to) your account several ways:

Airtime Cards

Buy an i-wireless card at an authorized distributor, including the Kroger family of stores such as Kroger, Ralphs, Dillions, Fred Meyer, Smith's, King Soopers, City Market, Fry's, Baker's, Owen's, JayC, Hilander, Gerbes, Scott's & Pay Less. To activate the i-wireless card, simply dial the number indicated on the i-wireless card or sales receipt (if applicable) and follow the prompts as directed.

i-wireless is not responsible for lost or stolen cards. i-wireless cards/PINs are for i-wireless prepaid minutes or Units only and have no cash redemption value. i-wireless cards/PINs are non-refundable and non-transferable.


Credit Card Funding

You can use a credit card to add funds by dialing #BUY from your i-wireless phone, by visiting wire.atl.cdit.us, or by calling 1-866-594-3644. The funds applied to your account are valid for i-wireless Services only and may not be redeemed for cash. All such funds are non-refundable.

You may use a credit card to apply a minimum of $25 to your account at one time. There is a limit of three credit card transactions per phone within a 30-day period.

If we discover that a credit card has been fraudulently used to fund your account, we will credit the card back with any unused, fraudulently applied funds and may, at our discretion suspend your Service. In addition, we reserve the right to implement other procedures, as we deem appropriate, if we suspect fraudulent credit card use.

Classic Plans Terms & Conditions

Classic Rate Plans:

i-wireless offers pay-per-use plans and individual and family monthly service plan options. The following provides a description of each:

Pay-Per-Use Plans:

The Basic Plan. The Basic Plan provides Service debited from your prepaid account at a flat rate of $0.20 per voice minute, $0.20 per outbound or sent text message and $0.20 per inbound or outbound multimedia message, such as picture mail. A voice minute is calculated per the description in "Measuring Usage" below. Usage will be deducted from your account during or immediately following use. An account balance greater than $0.20 is required to use the Service. If your balance falls below $0.20 during the call, Service may be interrupted. Service will be automatically available once additional funds are added to your account. Pay-Per-Use Plans provide a carry forward balance feature. At the end of the monthly period any unused Units can be carried forward into the next month, up to a maximum of 100 Units. Carry forward Units are non-transferable and cannot be redeemed for cash value.

Monthly Service Plans:

Monthly Service Plans include Individual rate plan options and Family Share plan options and involve purchasing a number of Units, which can used for placing or receiving calls or sending outbound text messages at any time of day. The Units are purchased by the payment of a monthly fee ("Monthly Service Fee"), as such fees are set forth below. One Unit is equal to one minute of voice service regardless of the time of day or one outbound text message. A voice minute is calculated per the description in "Measuring Usage," below. Each Unit used will be deducted from the number of Units purchased each month. If the total Units of your Monthly Plan are consumed prior to the start of the next billing cycle, additional funds can be added and will automatically be deducted from your available balance at the rate of $0.10 per minute. If the account balance is at zero, your account must be replenished before you can use the Service, except with respect to qualifying use under an unlimited plan, as set forth below.

Monthly Service Plans also provide a carry forward balance feature. At the end of the monthly period any unused Units can be carried forward into the next month, up to a maximum of 1,500 Units for Individual rate plans and 3,000 Units for Family Share rate plans. These carry forward Units will be added to the Units received at the beginning of the month and will be available for use throughout the month. At the end of the month any unused Units over the 1,500 limit for Individual rate plans or 3,000 unused Units for Family Share plans will not carry over. To carry forward Units into the next month, you must pay your Monthly Service Fee, or your account must have a sufficient balance for us to debit the Monthly Service Fee for the next month, by 12:01 a.m. on the normal billing date. If the Monthly Service Fee is paid after such time or your current account balance is insufficient to debit the Monthly Service Fee at such time, all carry forward Units are lost. Carry forward Units are non-transferable and cannot be redeemed for cash value. Unlimited Night / Weekend voice minutes and Unlimited text messaging do not apply to carry-forward Units.

If the Monthly Service Fee has not been paid or cannot be debited from your account, Service is available at the rate of $0.20 per Unit. All Units will be deducted from the available account balance. Once the balance reaches zero, Service will no longer be available until additional funds are added to your account. If a Family Share Plan account tops up with the monthly service fee within 30 days from the plan anniversary date, your previous rate plan selection will be restored.
The following sets forth the Monthly Service Fees (not including taxes or surcharges) for various Unit denominations.

Individual Plan Options:

  • $5.00 per month for $0.10 Anytime Units
  • $20.00 per month for Unlimited* Text Messaging
  • $25.00 per month for Unlimited* Text Messaging, Web and Email up to 200 megabytes and 200 Anytime Minutes
  • $40.00 per month for Unlimited* Text Messaging, Web and Email up to 500 megabytes and 1,000 Anytime Minutes
  • • $60.00 per month for Unlimited* Voice Minutes, Text Messaging, Web and Email up to 2.5 gigabytes

Picture Messages are charged at a rate of $0.20 each to send and receive. The $25, $40 and $60 rate plans listed above include 50 free Pictures Messages per month.

Family Share Plans:

To qualify for a Family Share Plan, all “MDN’s” (Mobile Dialing Number) must activated and be linked to a single “pooled” account. Pooled accounts may link two, three, four or five MDN’s to a single pooled account and select one of the following Family Share Plans listed below or the default pay-per-use rate, which is the same as the Basic rate plan. When linking MDN’s to a pooled account on the Family Share Basic Plan, any existing balances, dollars, plan minutes, data and/or FREE MINUTES will be transferred to the pooled account to be shared among the linked MDN’s and may not exceed a cap of 500 Units and 1 gigabyte of data. Any additional funds added to the pooled account will be deposited in the pooled account and are available for use by all linked MDN’s for as long as they are linked regardless of rate plan selection.

One MDN must be designated as the Primary Account Holder on the pooled account and has the ability to add and delete MDN’s from the Family Share Plan. The Primary Account Holder will also be responsible for storing any credit card information associated with the pooled account and will be the only user authorized to access, modify, alter or make changes to Credit Card Billing or Credit Card top-ups. When adding an MDN to an existing pooled account, the additional line will be charged the full incremental monthly service fee, regardless of the number of days remaining until the next monthly service fee renewal date. In the event that an MDN is removed from an existing pooled account, the MDN will automatically be defaulted to the Basic plan with a zero dollar and zero minute balance.

In the event that MDN’s assigned to a pooled account are “de-linked,” any remaining balance will be applied to the Primary Account Holder’s balance (all individual cap rules apply) and all other MDN’s will be defaulted to the Basic rate plan.

All Family Share Plans listed above include 50 free Picture Messages per MDN, per month. Additional Picture Messages are charged at a rate of $0.20 each to send and receive.

10¢ Anytime Plan. This plan provides Service debited from your prepaid account at a flat rate of $0.10 per voice minute, $0.10 per outbound text message and $0.20 per inbound or outbound multimedia message. The plan requires a monthly service fee of $5.00, which will be debited from your account each billing cycle. Usage will be deducted from your account during or immediately following use. A balance greater than $0.10 is required to use the Service. If your account balance falls below $0.10 during a call, Service may be interrupted. Service will be automatically available once additional funds are added to your account.

The Monthly Service Fee for your plan will be debited from your prepaid account at the beginning of each billing cycle until you cancel or change your rate plan. The Units purchased by paying the Monthly Service Fee are valid until your next plan renewal date, subject to the carry forward provisions set forth above.

We reserve the right to change the Monthly Service Fees set forth above or discontinue a rate plan at any time.

If you are on a Monthly Service Plan including an Individual rate plan or Family Share plan and your account balance is insufficient to debit the Monthly Service Fee for 30 consecutive days, we reserve the right to automatically migrate you to the Basic Plan.

Measuring Usage:

Rates that vary based on the time of a call will be determined based on the location of the network equipment providing Service for a particular call and not the location of your Phone or your Phone's area code. Airtime usage is measured from the time the network begins to process the call (before the phone rings or the call is answered) through the network's termination of the call (after you hang up). For billing purposes, the length of each call is rounded up to the next full minute. As an example, a call lasting 23 seconds will be billed as one full minute, as will a call lasting 49 seconds. Therefore, call time data displayed on your Phone may not necessarily reflect the number of airtime usage minutes charged on your account. Call time for billing purposes will be measured. Billable events are used for inbound and outbound voice calls, outbound text messages and inbound and outbound multimedia messages. Incoming text messages are free of charge with all service plans.

Unlimited Service:

To ensure that all i-wireless customers have access to reliable services provided at a reasonable cost, you may not use our Service in a manner that interferes with another i-wireless customer's use of our Service or disproportionately impacts i-wireless' network resources.

i-wireless service is intended for personal use only. We have determined that placing a high number of calls, sending or receiving unusually high numbers of messages or data usage or repeatedly placing calls of unusually long duration relative to typical usage by other customers on similar service plans suggests that a mobile phone or device is being used other than for personal use, and is in violation of these Terms and Conditions. If we determine at our sole discretion that you are using an unlimited or other service in violation of these Terms and Conditions or other i-wireless rule or policy, or in any other manner that we deem to be unreasonable or excessive, then we may terminate individual calls or data connections or terminate your Service, decline to renew your Service or offer you a different service plan with no unlimited usage component at any time. We will provide notice via text message that we intend to take any of the above actions.

Unlimited service options are not available with any Pay-Per-Use plans or any expired rate plans.

Unlimited Voice Minutes:

This option allows unlimited voice calls during the monthly period the Service is offered. Carry forward Units are not available with this option.

Unlimited Texting:

Unlimited Text Messaging is available for $20 per month. Minutes are billed at the rate of $0.10 per minute regardless of the time of day. This plan is subject to the terms and conditions associated with the 10¢ Anytime Plan. Unlimited text messaging is also included in select Individual rate plans and Family Share rate plans. With unlimited text messaging, you are able to send outbound text messages during the entire month of service regardless of your account balance. Unlimited text messaging does not include sending or receiving multimedia messages.

Switching Among Plans:

Unless otherwise provided in these Terms and Conditions, you may switch between any available rate plan at any time; however, Monthly Service Fees are not refundable. When you switch between rate plans you will not receive a refund of any portion of any previously paid charges. For that reason, we recommend that you switch at the end of your monthly billing cycle if you are on a Monthly Service Plan or after you have used your Units, messages or data allotment. When switching between different Monthly Service Plans, Individual rate plan subscribers can transfer up to 1,500 carry forward Units and Family Share plan subscribers can transfer up to 3,000 carry forward Units. When switching from the Basic Plan to a Monthly Service Plan your existing unexpired account balance and up to 100 carry forward Units will be transferred. When moving from a Monthly Service Plan to the Basic plan, a maximum of 100 carry forward Units will be transferred. Repeated switching is not permitted and may result in termination of Service.

FREE WIRELESS REWARDS:

The FREE WIRELESS REWARDS program is administered by i-wireless. If you are a registered participant in the FREE WIRELESS REWARDS program, you will earn a wireless reward for every $100 spent on qualifying purchases at select Kroger-owned store locations when using a registered Kroger family Shopper's cards, Rewards card or 1-2-3 Rewards MasterCard or Visa.

For every $100 spent on qualifying purchases in store, 20 FREE MINUTES of airtime will automatically be applied to your account balance. If you subscribe to an Individual service plan with an unlimited voice component, you will automatically receive a $1.00 credit applied to your account balance in lieu of minutes for every $100 in qualified spending. If you subscribe to a Family Share service plan, you will automatically receive a $2.00 credit applied to your pooled account balance in lieu of minutes for every $100 in qualified spending. If you have registered and authorized recurring billing to your 1-2-3 Reward's MasterCard or Visa, you will receive 30 FREE MINUTES of airtime applied to your account balance or a $1.50 credit if you subscribe to an Individual service plan with an unlimited voice component for every $100 in qualified spending. You must spend $100 or more to receive the reward. The total amounts you spend will not be rounded up (i.e. 99¢ will not be rounded up to $1.00). Rewards minutes may only be redeemed once (1) per household, per $100 in qualified spending. Qualified purchases do not include payments for taxes, office services, alcohol, tobacco, fuel, tickets, Western Union, Green Dot cards, MoneyPak, Kroger Gift Cards and any purchases prohibited by law. i-wireless and Kroger reserve the right to exclude other purchases. No coupon or certificate is needed to earn rewards minutes.

A maximum of two Kroger family Shopper's cards, Rewards cards or 1-2-3 Rewards MasterCard or Visa may be registered against any one i-wireless MDN. A maximum of ten Kroger family Shopper’s cards, Rewards cards or 1-2-3 Rewards MasterCard or Visa (2 cards per MDN) may be registered against any one Family Share plan pooled account. No more than a $1.50 credit or 30 FREE MINUTES can be earned on any Individual rate plan for every $100 in qualified spending, and a maximum of 1,000 minutes can be earned within a 30-day period. No more than a $2.00 credit can be earned on any Family Share plan pooled account for every $100 in qualified spending. Certain rate plans may receive a dollar credit applied to the account in lieu of minutes. FREE MINUTES are usually applied within 48 hours after the $100 threshold for qualifying purchases is met.

FREE WIRELESS REWARDS may only be redeemed for Kroger i-wireless service in connection with a qualifying i-wireless rate plan, require the use of an i-wireless phone, and are subject to these Terms and Conditions. Minutes earned under the FREE MINUTES program may be used for inbound or outbound text messaging and peak and off-peak voice service, however, these minutes may not be used to send or receive multi-media messages. If you subscribe to a Pay-Per-Use plan, minutes earned under the FREE WIRELESS REWARDS program shall be consumed first. In addition, Pay-Per-Use plan subscribers cannot accumulate more than 100 unused FREE MINUTES at any time. If you have reached the unused minute cap, additional FREE MINUTES will not be awarded until you fall below the 100-minute limit. FREE WIRELESS REWARDS may not be earned if your account is past its Balance Expiration Date. Kroger and i-wireless reserve the right to alter, limit or modify the FREE WIRELESS REWARDS program rules, regulations, rewards, reward level, registration process, or to terminate the FREE WIRELESS REWARDS program at their sole discretion, without notice. By participating in the FREE WIRELESS REWARDS program, you and your household agree to allow i-wireless to use information collected for the marketing purposes of i-wireless, Kroger and their respective affiliates. Please see our Privacy Policy for additional details. This is a limited time offer and not available where prohibited by law.

Intelligent Debiting:

If you have registered for Monthly Credit Card Billing and subscribe to a service plan with a monthly service fee, (with the exception of the $5.00 per month/$0.10 minute plan) you must comply with the intelligent debiting of your account. If your account balance is greater than the total amount of your full monthly service fee, plus applicable tax on your monthly renewal date, i-wireless will automatically deduct the amount from your account, instead of charging the credit card on record. Successfully debiting the monthly service fee from your account will renew the expiration date by 90 days. If your account balance is less than the full monthly service fee amount plus applicable tax, i-wireless will process the registered credit card on file for full payment of the monthly service fee, plus applicable tax.

Other Charges:

Data Services are available and may be dependent upon the make and model of the device purchased. A data session begins from the time the subscriber accesses the Internet via the mobile device or via the Mobile Hotspot feature available on some devices until such time as terminated by the subscriber or the network. Multiple sessions can be initiated within a single day or 24 hour period and will be billed as independent events. In addition to the data allotment included with some rate plan options, you may purchase incremental allotments of data to access the mobile Internet or Mobile Hotspot feature in the following data increments known as “Mobile Web Packs”:

  • Mobile Web 100MB = $5 for 100 MB
  • Mobile Web 300MB = $20 for 300 MB
  • Mobile Web 1GB = $30 for 1GB

Your data usage will be deducted from the available data balance on your account. If you use your allocation of data before the end of the monthly period, you will be charged for data at the rate of $0.01 per ten kilobytes to access the mobile Internet (the “Overage Rate”) on each day that you access the mobile Internet for the remainder of the period, provided that you have a sufficient balance in your account.

You may add a data allocation via a Mobile Web Pack by logging into your “My Account” page on the website or by accessing the “My Account” feature on the WAP deck on your mobile phone.

Picture messages are billed at a rate of $0.20 each to send and receive. Rates are subject to change.

Additional content downloads will automatically be deducted from the user’s available account balance. Rates vary and are subject to change.

Domestic and International Long Distance allow you to call anywhere in the U.S. and anywhere in the world. In the event you place an International Long Distance call from your Phone, your account will be debited an amount equal to the cost of such call, and the cost shall be calculated based upon the International Long Distance rates currently in effect multiplied by the number of minutes used. Rates and country codes are available at wire.atl.cdit.us.


Calls to Directory Assistance (411) are one dollar fifty cents ($1.50) each plus local per-minute charges. Rates are subject to change.

International Long Distance calls are additional charges: as such, the airtime minutes used are included and the minutes used will not be debited against your minute balance.

Standard airtime charges (i.e. $0.20/$0.10 per minute of voice airtime under the Pay-Per-Use Plans and one Unit per 1 minute of voice airtime under the Monthly Service Plans) apply to 800, 866, 877 and other toll-free calls, whether or not they are made during peak or non-peak hours.

Incoming advertising alerts or other broadcast messages from i-wireless or its authorized agents. Such incoming calls and messages are not charged against your account balance.

Taxes and Surcharges:

Stated prices for our Services do not include taxes or surcharges. Taxes include state and local sales taxes, as well as surcharges for federal and state Universal Service Fund contributions and state and local 911 fees. Charges may also include a cost recovery surcharge. The amount of these surcharges may vary from time to time and by area.

Expiration:

You must replenish your account with funds of at least ten dollars ($10) within 30 days of the activation date of your account and within every 30 days thereafter or you will lose your right to use any unused value in your account and your account will be suspended. The balance will expire at 12:01 a.m. on the Balance Expiration Date. The Balance Expiration Date is based on the calendar month and calculated by i-wireless at the time you apply the funds. Adding funds to your account before your balance expires or is suspended will give a new Balance Expiration Date to both your old balance and your new balance.

Replenishing Your Account:

You can replenish (i.e. add funds to) your account several ways:

Airtime Cards

Buy an i-wireless card at an authorized distributor, including the Kroger family of stores such as Kroger, Ralphs, Dillions, Fred Meyer, Smith's, King Soopers, City Market, Fry's, Baker's, Owen's, JayC, Hilander, Gerbes, Scott's & Pay Less. To activate the i-wireless card, simply dial the number indicated on the i-wireless card or sales receipt (if applicable) and follow the prompts as directed. Each i-wireless card denomination is valid for a specific number of days, which is published on the back of the card, once the i-wireless card has been applied to the account. The number of days an i-wireless card is valid is as follows:

  • $10 airtime cards are valid for 30 calendar days from the date of activation.
  • $25 airtime cards are valid for 60 calendar days from the date of activation.
  • $35 airtime cards are valid for 90 calendar days from the date of activation.
  • $50 airtime cards are valid for 90 calendar days from the date of activation.

Upon the expiration of such period (i.e. 30/60/90 days), any remaining value will expire, except that if a new i-wireless card is added before expiration of the period or your account is otherwise replenished with at least ten dollars ($10), the existing balance will automatically be carried over to your account's new Balance Expiration Date, subject to the carry-forward maximums set forth in the section "Switching Among Plans."

i-wireless is not responsible for lost or stolen cards. i-wireless cards/PINs are for i-wireless prepaid minutes or Units only and have no cash redemption value. i-wireless cards/PINs are non-refundable and non-transferable.

Credit Card Funding

You can use a credit card to add funds by dialing #BUY from your i-wireless phone, by visiting wire.atl.cdit.us, or by calling 1-866-594-3644. The funds applied to your account are valid for i-wireless Services only and may not be redeemed for cash. All such funds are non-refundable.

You may use a credit card to apply a minimum of $20 to your account at one time. You may not apply more than $300 including any applicable tax to your account with a credit card in any 24-hour period and you may not exceed a $400 cash balance at any time. Money applied to your account via a credit card is valid for 90 calendar days from the date of purchase. There is a limit of three credit card transactions per phone within a 30-day period.

If we discover that a credit card has been fraudulently used to fund your account, we will credit the card back with any unused, fraudulently applied funds and may, at our discretion suspend your Service. In addition, we reserve the right to implement other procedures, as we deem appropriate, if we suspect fraudulent credit card use. The maximum permissible account balance is $400, therefore you may not apply additional funds until your account balance is below the $400 threshold.
